In the event that we refuse, modify, or cancel your order, we will attempt to contact you using the email address, billing address, and/or phone number provided at the time the order was placed. We decline any responsibility for delays caused by carriers, customs formalities, or any event beyond our control. As soon as the products are handed over to the carrier, ownership and risk of loss transfer to you.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of the sales between you and Héritage Sélection, including any damage, harm, or loss resulting from the products or services purchased. ARTICLE 18 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Héritage Sélection, Shopify, as well as our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers, harmless from any loss, damage, liability, or claim, including reasonable attorneys' fees, made by any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access and use of the Services. We will notify you of any claim covered by this indemnity, provided that a failure to notify promptly does not relieve you of your obligations unless you suffer substantial prejudice as a result. We may assume the defense and settlement of any claim at your expense, including the choice of legal counsel, but we will not settle any claim involving non-monetary obligations on your part without your agreement (which you may not unreasonably withhold). You will cooperate in the defense of any claims covered by this indemnity, notably by providing relevant documents.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the federal laws and the laws of the states or territories of the competent courts in the jurisdiction where Héritage Sélection has its registered head office. You and Héritage Sélection expressly consent to the territorial and personal jurisdiction of these courts.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. We will notify you of any material changes to these Terms in accordance with applicable law, and such changes will take effect on the date indicated in the notice. Your continued use of or access to the Services following the posting of any changes to these Terms constitutes acceptance of those changes.

ARTICLE 26 - Authenticity Guarantee

At Héritage Sélection, authenticity is not an option; it is our absolute commitment. Each piece in our collection undergoes a rigorous, multi-step verification process before being offered for sale.

1. Physical Expertise Our team of experts thoroughly inspects each item in person. We analyze the specific authenticity markers unique to each luxury fashion house, including:

  • The quality and origin of the materials (leathers, textiles, metals).

  • The precision of the craftsmanship (stitching lines, pattern alignment).

  • The finish and weight of the hardware (zippers, clasps, logos).

2. Cutting-Edge Technology and Partnerships To guarantee infallible accuracy, we collaborate with global leaders in third-party authentication, such as Entrupy or Real Authentication.

  • Entrupy: Utilizing a microscopic camera and advanced artificial intelligence, the item is compared against a database of millions of images to detect the slightest structural anomaly.

  • Each item certified by these tools receives an official certificate of conformity.

3. Policy Regarding Non-Authentic Items The integrity of our inventory is paramount.

  • Authentic Items: Only items confirmed as authentic are purchased by Héritage Sélection and put up for sale.

  • Non-Authentic Items: Any item deemed non-authentic is immediately returned to the supplier or donated to a charity after 14 days if left unclaimed.

  • Authentication Fees: A fee of $75 will be charged to the supplier for any non-authentic item (these fees may vary for exceptional pieces, particularly from the house of Hermès).

4. Processing Time Quality expertise takes time. We require a period of 2 to 3 business days to complete a thorough and rigorous full authentication of your pieces.
